When you pay for services or products from Liquid Beauty, your payment information (credit card number, expiration date, and CVV code) it is sent directly to a secure third-party credit card processing center and gets the transaction will get recorded by My Aesthetics Pro, our third party electronic medical records software, or Weave, our third party communications and payment processing vendor. Liquid Beauty does not store any direct credit card or 3rd party payment information. We do store billing addresses, generic payment type, and the last four digits of your credit card for your convenience during the transaction process.

Please be aware that such communications (with the exception of My Aesthetics Pro or Weave messaging platforms)  are not a secure email network under HIPPA guidelines. Do not submit any personal or private information unless you are authorized and have voluntarily consented to do so. We are not liable for any HIPAA violations. Understand that if you contact us via any platform that is not My Aesthetics Pro or Weave, you are agreeing to the use of an unsecured method and understand that all replies will be sent in the same fashion, which you are hereby authorizing and consent to.

We take commercially reasonable steps to safeguard and deter unauthorized access to your information. Liquid Beauty complies with the Payment Card Industry Data Security Standard (PCI DSS). This means that when we collect or transmit sensitive information such as a credit or debit card number, we use industry standard methods to protect that information.

Although we take reasonable measures to safeguard against unauthorized disclosures of your information, no e-commerce platform, website, electronic database or system is completely secure.

Liquid Beauty is located in the United States, and we primarily store your information in the United States. By using our website and/or providing us with information, you are agreeing to transfer and store your data in the United States.

To our international customers: the privacy laws and standards in the United States, including the level of protection applied to your data and the rights of authorities to access your personal information, may differ from those that apply in the country in which you reside. My Aesthetics Pro is a third party service that Liquid Beauty uses for our HIPAA compliant electronic medical records system. By booking an appointment online, you are consenting for your information to be collected by My Aesthetics Pro. Your health information, treatments received, clinical notes, messages received and sent through My Aesthetics Pro, photos, and financial transactions will all be stored by My Aesthetics Pro. Liquid Beauty will periodically take clinical photos of you to establish clinical baseline medical records, as well as document changes due to treatments rendered by Liquid Beauty. RxPhoto is a clinical photography photo management, documentation, and storage platform for the dermatology, aesthetics, plastic surgery, vein treatment, medical spa and wound care fields. RX Photo collects information about Liquid Beauty’s patients through Liquid Beauty’s use of RxPhoto and RxPortal mobile apps, along with the companion RxAdmin website. Your photos are stored on RX Photo, a third party vendor that we contract to provide HIPPA compliant photo management software program services. Weave

Weave is a third party service that Liquid Beauty uses for telecommunication, texting, and payment processing that is HIPAA compliant. By calling or texting our office, you are consenting for your information to be collected by Weave. Your personal information, financial information, and communication records will all be stored by Weave. These additional disclosures apply only to individuals who reside in California. The California Consumer Privacy Act (“ CCPA ”) provides certain rights to California residents. The words used in this section have the meanings given to them in the CCPA, which may be broader than their common meaning.

A. Notice of Collection.

As described above in the “Information We Collect” section, we collect and use several categories of personal information about you for our business purposes. Some of this information is shared with our trusted service providers in order to improve your website experience and to complete your order or communicate with you.

B. Request to Know / Request to Delete.

You have the right to request that we disclose certain information to you about our collection, use, disclosure, and sale of your personal information over the past 12 months.

In the “Information We Collect” section above, we disclose

  • The categories of personal information we collected about you.
  • The categories of sources for the personal information we collected about you.
  • Our business or commercial purpose for collecting that personal information.
  • The categories of third parties with whom we share that personal information.

You also have the right to request that we disclose the specific pieces of personal information we collected about you. Once we receive and confirm your verifiable consumer request, we will disclose to you:

  • The specific pieces of personal information Liquid Beauty has retained about you.

You also have the right to request that we delete any of your personal information that we collected from you and retained, with certain exceptions. We are unable to delete information about you once you have received services with us, a consultation with us, or purchased a product from us because the law requires that we keep medical records. Once a consumer request is received, we provide instructions for you to verify your identity and delete (and direct our service providers to delete) your personal information from our records, unless an exception applies.

We reserve the right to retain and will not delete information that is necessary for us or our service providers to retain in order to:

  • Complete the transaction for which we collected the personal information, provide a product or service that you requested, take actions reasonably anticipated within the context of our ongoing business relationship with you, or otherwise perform our contract with you.
  • Detect security incidents, protect against malicious, deceptive, fraudulent, or illegal activity, or prosecute those responsible for such activities.
  • Debug products to identify and repair errors that impair existing intended functionality.
  • Exercise free speech, ensure the right of another consumer to exercise their free speech rights, or exercise another right provided for by law. Comply with the California Electronic Communications Privacy Act (Cal. Penal Code § 1546 et. seq.).
  • Enable solely internal uses that are reasonably aligned with consumer expectations based on your relationship with us.
  • Comply with a legal obligation.
  • Make other internal and lawful uses of that information that are compatible with the context which you provided it.

How to Request to Know or Request to Delete

If you have an account with Liquid Beauty through My Aesthetics Pro, Weave, or RxPortal, you can make these request to delete your data if we have not seen you as a patient and no products were purchased from us. Medical record keeping laws prevent us from deleting data once you are a Liquid Beauty patient. Please email us at info@liquidbeauty.com to request us to delete your account.

If you do not have an account with Liquid Beauty, but have contacted us via text or email, you can obtain a report of the specific pieces of personal information we have collected and retained by emailing us at info@liquidbeauty.com

You can also submit verified consumer requests by calling us at 714-800-3091 or by email info@liquidbeauty.com. We may require specific information from you to help us verify your identity and process your request. If we are unable to verify your identity, we may deny your requests to know or delete.

C. Right to Opt-Out.

You have a right to opt out of any sale of your personal information. Liquid Beauty does not sell your personal information to any other retailers. However, our website integrates technologies of trusted advertising partners (third-party companies) that allow the recognition of your device and the collection of information about your browsing activity in order to provide advertisements about goods and services likely to be of greater interest to you. In particular, these partners collect information about your activity on Liquid Beauty to enable us to show advertisements for our products and/or services to you on third-party websites and apps. If and to the extent “sale” under the CCPA is interpreted to include advertising technology activities such as those implemented specifically for interest-based advertising, we will comply with applicable law as to such activity. See the section on “Interest Based Advertising” above for information about how to opt out of interest based advertising.

D. Authorized Agent.

You can designate an authorized agent to submit requests on your behalf. However, we will require written proof of the agent’s permission to do so and verify your identity directly.

E. Right to Non-Discrimination.

You have the right not to receive discriminatory treatment by us for the exercise of your privacy rights. We will never discriminate against you for exercising your privacy rights. However, there are certain functions of our website and app that are only available to account holders, such as certain promotions and messaging via My Aesthetics Pro, RX Photo, and Weave platforms.

F. Financial Incentives.

We may offer incentives to customers that involve sharing of personal information with us. The personal information collected and retained by us in operating these programs is described in this Privacy Policy, and includes your name and contact details, your date of birth information, your payment information, your contact history with us, your purchase and product feedback history, additional details about you, information about your device type and how you use our website, your public reviews and blog comments and inferences from data and other personal information we may collect in connection with your interaction with our service and/or participation in any of our promotional programs.

Benefits provided through our promotional programs may be deemed a “financial incentive” (e.g., promotional goods) and/or “differential services” (e.g., discounts, coupons, other promotions) under the CCPA. We currently offer the following promotional programs in connection with the collection and retention of Personal Information:

  • Program: We offer rewards to customers who have a My Aesthetics Pro account for Liquid Beauty or who follow us on social media platforms such as Google, Yelp, Instagram, Facebook, and Tik Tok, etc. Participants in may receive promotional offers, including discounts, coupons and opportunities to participate in other promotional opportunities. You can subscribe to receive these promotional offers by registering for a My Aesthetics Pro Liquid Beauty account or following us on any of our social media accounts.
  • Surveys: You may also be offered the opportunity to participate in a survey. Participation in the survey may result in Liquid Beauty collecting additional information from you, including your preferences, experiences, beliefs, opinions, and responses to the survey questions. In exchange for your participation in the survey, you may be offered a financial incentive, as described above.
  • Limited-Time Promotions: From time to time, we may offer incentives limited to a specific time period, or time limited sweepstakes, contests and other promotions. Participation in a limited-time offer or promotion is governed by the applicable terms and conditions for the program, which will also describe any financial incentives associated with the promotion.
  • Discounts: We also from time to time offer discounts connected to customer’s submission of their email address, phone number or other personal information. You can always opt out of our marketing emails or SMS messaging at any time.

For CCPA purposes, we treat the value of your Personal Information collected through our promotional programs as equivalent to our total program expenses (excluding the value of benefits). The value of each program is the value of the program benefits, including discounts and coupons, the value of which will depend on individual customer participation. By participating in our promotional programs, you agree that the benefits are reasonably related to the value of the Personal Information collected and retained.

Participation in our promotional programs is always optional, and you can terminate program participation at any time as explained in applicable program terms. You can also contact us at info@liquidbeauty.com to unsubscribe or cancel your participation.

G. Shine the Light.

California Civil Code Section 1798.83 permits customers of Liquid Beauty who are California residents to request certain information regarding its disclosure of personally identifiable information to third parties for their direct marketing purposes. However, at this time we do not share any of your personally identifiable information with third parties for their direct marketing purposes.
